The Cobb County DUI Court recently celebrated its 10th year of operation. Over the last decade, more than 525 repeat DUI offenders have entered the court with 391 of these individuals graduating. The court reports that each year there are more than two million drivers with at least three DUI convictions in the country and that yearly, more than two thirds of alcohol impaired fatalities involve a driver with a blood alcohol content of .15 or higher.
A study conducted by the Governor’s Office of Highway Safety reveals that two years after graduating DUI court, participants are four times less likely to have a DUI arrest than non-participants. To qualify for enrollment in the program, a participant must have two DUIs within a 10-year period. Cobb County also has a drug treatment court for residents who are arrested on drug possession charges.
In Georgia, repeat DUI offenders and some first-time offenders who meet certain requirements have the option of attending DUI court instead of traditional penalties. These courts are unique because they combine alcohol (and drug) treatment with court supervision. Rather than exist to punish motorists, DUI courts focus on making certain that drivers do not commit DUI crimes in the future. If you have been charged with a DUI in Georgia and are wondering whether a DUI court is a suitable option, it is often a wise idea to speak with a knowledgeable DUI attorney who can help you determine if the program is a good fit.
The Advantages of DUI Court
Because they are intensive programs that keep individuals focused on substance abuse treatment, DUI courts offer the advantage of reducing the risk that a person will drive while drunk. Research has shown that people who enter treatment from the legal system remain there longer and that these individuals have more successful long-term results.
Some of the other advantages offered by Georgia’s DUI courts include decreased jail time, reduced fines, and a shorter wait to have your driver’s license reinstated.
Given these numerous advantages, it is easy to understand why many people discover the DUI court process is particularly helpful.
Risks Involved with Georgia’s DUI Court
DUI convictions often result in license suspension, which means that many people experience difficulty in arriving at these programs. Another common disadvantage to DUI courts is that it can be difficult to maintain privacy while enrolled in the program due to the mandated supervised visits. Another disadvantage is that DUI court programs are often very rigid, and if a person violates even a small term, he or she can end up facing very serious penalties. Some of these penalties include community service and jail time.
